Welcome to DisMornings. These Terms and Conditions outline the rules and regulations for the use of the DisMornings website (dismornings.com), the DisMornings Apparel store (dismornings.store), and the DisMornings Vacation Planner iOS application (collectively, the “Services”).

2. DISMORNINGS VACATION PLANNER APP

This section applies specifically to the DisMornings Vacation Planner iOS application (“the App”), available on the Apple App Store.

2.1 Subscription and Access

The DisMornings Vacation Planner is a subscription-based service. Access to the App requires an active paid subscription purchased through our website at dismornings.com.

Subscriptions are billed annually at the rate displayed at the time of purchase
Payment is processed securely through Stripe
Your subscription begins immediately upon successful payment
Login credentials will be delivered to your email address following successful payment

2.2 Account Credentials

Upon subscribing, you will receive a unique email address and password to access the App. You are responsible for:

Keeping your login credentials confidential
All activity that occurs under your account
Notifying us immediately at [email protected] if you suspect unauthorized use of your account

Sharing your login credentials with others is a violation of these Terms. Accounts are limited to use on a maximum of 2 devices simultaneously. Violations may result in suspension or termination of your account without refund.

2.3 Acceptable Use

You agree to use the App only for lawful, personal, non-commercial purposes. You must not:

Attempt to reverse engineer, decompile, or extract the source code of the App
Use the App to collect or harvest data about other users
Interfere with or disrupt the App’s servers or networks
Use the App in any way that violates applicable laws or regulations

2.4 Third-Party Services

The App integrates with the following third-party services to provide its features:

Stripe — payment processing for subscriptions
Resend — transactional email delivery (welcome emails, password resets)
ThemeParks.wiki — live wait times, park hours, and show schedules
Queue-Times.com — historical wait time data
Railway — backend infrastructure and data storage

Each of these services operates under its own terms and privacy policies. DisMornings is not responsible for the availability, accuracy, or conduct of these third-party services.

2.5 Live Data and Accuracy

The App displays live and historical data from third-party sources including wait times, park hours, Early Entry schedules, Deluxe Evening Hours, special event information, and show times. This data is provided for informational purposes only.

DisMornings does not guarantee the accuracy, completeness, or timeliness of any data displayed in the App. Park hours, wait times, and schedules are subject to change without notice by Disney or other operators. Always verify critical trip information directly with Walt Disney World Resort.

2.6 Subscription Cancellation and Refunds

You may cancel your subscription at any time by contacting us at [email protected]
Cancellation takes effect at the end of your current annual billing period
Access to the App will continue until the end of your paid subscription period
We do not offer refunds for partial subscription periods except where required by applicable law
If you experience a technical issue that prevents you from accessing the App, contact us and we will work to resolve it promptly

2.7 Changes to the App and Pricing

DisMornings reserves the right to:

Modify, update, or discontinue features of the App at any time
Change subscription pricing with reasonable advance notice to existing subscribers
Discontinue the App with reasonable advance notice

We will notify existing subscribers of material changes via email.

2.8 Disclaimer of Warranty for the App

The App is provided “as is” without warranty of any kind, express or implied. DisMornings does not warrant that:

The App will be available at all times without interruption
The App will be free of errors or bugs
Data provided by third-party sources will be accurate or current

2.9 Limitation of Liability

To the maximum extent permitted by applicable law, DisMornings shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to trip planning decisions made based on information displayed in the App.

2.10 Apple App Store Terms

The App is distributed through the Apple App Store. Your use of the App is also subject to Apple’s Terms of Service. DisMornings, not Apple, is solely responsible for the App and its content. Apple has no obligation to provide maintenance or support for the App.

3. PRIVACY

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms and Conditions by reference.

4. CHANGES TO THESE TERMS

DisMornings reserves the right to update these Terms and Conditions at any time. We will notify users of material changes via email or by posting a notice on our website. Continued use of our Services after changes are posted constitutes your acceptance of the updated terms.

5. GOVERNING LAW

These Terms and Conditions are governed by the laws of the State of Ohio, United States. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Ohio.
